The High Court in Kampala has rejected to issue order to exhume the body of the late socialite and businessman Ivan Semwanga AKA Don. This comes after a one Abey Mgugu requesting to exhume Semwanga‘s body and remove the money that was buried in his grave on the basis that it was the abuse of a legal tender. On Monday afternoon, judge Margret Oguli -Oumo declined to issue an order in Mgugu’ s case he had opened against Bank of Uganda and A-plus funeral mgt which had been contracted to carry out burial arrangements.

On May 30, 2017 at Nakaliro while burying Ivan Members of Rich gang poured some money in currencies of Ugandan shillings, South African Rand and US Dollars. This angered Mgugu as a concerned citizen, he rushed to court to penalize two entities for their negligence of their duties.

While reading her ruling, Justice Oguli revealed that A-plus funeral management owed no duty to Mgugu since the mode of contract that Semwaga’s family entered with the funeral company his case.

She also exonerated Bank of Uganda of neglecting its statutory duty to protect currency notes saying a careful perusal of the Bank of Uganda Act gives it no duty to enforce respect of the Ugandan currency and those from other jurisdictions such as the US dollar and the South African Rand that Mgugu claims were also thrown in Semwanga’s grave.
