Jinja High Court Judge Eva Luswata has declined to refer King Mumbere’s bail application to the International Crimes Division Court as earlier requested the by the Director of Public Prosecutions.
A team of state attorney’s from the Directorate of Public Prosecutions led by Alex Ojok informed court that they had instructions to oppose the King’s bail on grounds that being an Influential person in the Kasese region, he has capacity to interfere with and frustrate the on-going police
However, Justice Luswata ruled that at this stage when the DPP has not yet committed Mumbere for trial before the ICD, the king can appear before any High Court judge for purposes of bail hearing.
The judge says the Constitution gives the High Court unlimited jurisdiction to entertain all matters and therefore she does not need to be designated as an ICD judge by the Principle Judge to hear this application.
After dismissing the DPP’s application to have Mumbere’s bail application transferred to a single judge of the ICD and ordered the King’s lawyers led by Caleb Alaka to proceed with presenting their sureties, Justice Luswata set tomorrow’s date as the day she is to deliver a ruling on the bail application filed by Rwenzururu King Charles Wesley Mumbere.
This was after he presented 6 sureties including 5 Members of Parliament, namely:
Hon. Winnie Kiiza the Woman Member of Parliament for Kasese and the Leader of the Opposition in the current Ugandan Parliament. She is an in-law to the King.
She is a resident in both Kampala and Kasese.
Hon. William Nzughu the Member of Parliament for Busongora North Constituency. He is a maternal Uncle to the King. He is a resident of both Kampala and Kasese.
Hon. Katusabe Atkins, Member of Parliament for Bukonzo West Constituency. He is a resident in both Kampala and Kasese. The Applicant is his personal friend( his keen).
Hon. Centenary Franco Robert. Member of Parliament for Kasese Municipality. Resident of both Kampala and Kasese. The King is his Maternal Uncle and the residence of the King falls squarely in his constituency.
Hon. Muhindo Tony Harold. Member of Parliament for Bukonzo East Constituency. Resides both in Kampala and Kasese.
Mr. Constantine Bwambale, former Prime Minister of the Kingdom who served for close to nine year. He is also a close friend to the King. Resident of Kasese.
The other MPs standing as surety for the king are Robert Centenary of Kasese Municipality, Tonny Muhindo of Bukonzo East, William Nzoghu of Busongora North and Atikins Katusabe from Bukonzo West.
The sureties have undertaken to bring back the king to court as and when he is required to do so.
