Court has thrown out Wakayima Musoke Nsereko, the Nansana Municipality Member of Parliament in Wakiso district on grounds that he is not a registered voter. Justice Vincent Okwanga made the judgment this afternoon in his ruling on an action filed by Wakayima’s rival, Robert Kasule Ssebunya challenging his election.
In his judgment, Justice Okwanga observed that during his nomination, the respondent presented himself as Wakayima Musoke Nsereko, which can’t be traced on the voter’s register. Court heard that the respondent carries a national identity card in the name of Musoke Hannington Nsereko. Electoral laws demand that candidates for a particular leadership position should be on the voters’ register.
The Judge subsequently ruled that the respondent was erroneously nominated by the Electoral Commission and does not qualify to be a law maker. To that effect, Justice Okwanga declared Ssebunya, the first runner-up in the February 18 elections the duly elected MP for Nansana Municipality and awarded him costs of the suit.
However, in further analyzing his ruling, Justice Okwanga didn’t dispute Wakayima’s academic papers, saying he satisfied court that he sat his exams as Musoke Hannington. He ruled that Ssebunya didn’t prove that the said academic papers do not belong to the respondent since nobody has come out to claim them.
The Judge also observed that he found it irregular for the Wakiso District Returning Officer, Sarah Bukirwa to cancel results from 24 polling stations without any justifiable reason.
